General Terms and Conditions (Terms)

1. Scope

These Terms apply to all orders placed through this online shop with Digitec Galaxus AG (hereinafter “the Seller” or “we”). Deviating terms of the customer are not recognised unless we have expressly agreed to them in writing.

The version of these Terms published at the time of the order applies.

2. Offer and conclusion of contract

The presentation of products in the shop is not a legally binding offer but an invitation to order. Colour and storage capacity must be selected before adding an item to the cart; this selection determines the item and its price.

By submitting your order you make a binding offer to purchase the products in your cart. The contract is concluded when we confirm your order by e-mail (order confirmation) or dispatch the goods.

We reserve the right to refuse orders, in particular in case of unavailability, obvious pricing errors or a reasonable suspicion of abuse. Any payments already made will be refunded in full.

3. Prices and VAT

All prices are stated in Swiss francs (CHF) and include statutory VAT. The applicable price is the one shown at the time of the order in the cart and in the order confirmation.

Any shipping costs are shown separately before the order is completed. Shipping costs may apply to orders under CHF 50.–.

4. Lucky-wheel discount

The shop may offer a lucky wheel. The discount won is genuine and is automatically deducted from the cart total at checkout.

• One participation per device; each win can be redeemed only once.
• The discount applies to the promotional products in the cart and cannot be combined with other discounts.
• No cash payout and no retroactive application to earlier orders.
• In case of manipulation or misuse, the discount may be refused or the order cancelled.

5. Payment

Payment is made using the methods offered during checkout (in particular TWINT or bank transfer). No credit-card data is stored in this shop.

For prepayment, goods are dispatched after receipt of payment. If payment is not received, we may withdraw from the contract and sell the goods elsewhere.

6. Delivery

Delivery is made to the address you provide. After receipt of your order you will receive an order confirmation by e-mail; dispatch takes place no earlier than 5 days after receipt of the order. Pre-orders are shipped in the order in which they are received.

Stated delivery times are estimates and not binding delivery dates. If a product is unavailable we will inform you promptly and refund any payments already made.

Please check the parcel on receipt for visible damage and report it immediately to the address given at the bottom of the page.

7. Retention of title

Delivered goods remain the property of the Seller until paid in full.

8. Returns and exchanges

Swiss law provides no statutory right of withdrawal for online purchases. Unopened products in undamaged original packaging may be returned by prior arrangement within 14 days of receipt; return shipping costs are borne by the customer unless the return is due to a defect.

Opened, used or personalised products and activated devices are excluded from return unless defective.

9. Warranty

The statutory warranty rights under the Swiss Code of Obligations (Art. 197 ff. CO) apply. The warranty period is two years from delivery.

Defects must be reported to us promptly after discovery. In case of a justified claim we will, at our option, repair, replace or reduce the price; if this is not possible, the purchase price will be refunded. Manufacturer warranties remain unaffected.

10. Liability

We are fully liable for damage resulting from injury to life, body or health and for intent and gross negligence. Otherwise, liability for slight negligence, indirect and consequential damage and loss of profit is excluded to the extent permitted by law.

We accept no responsibility for the content of external websites we link to.

11. Data protection

We process personal data only to the extent necessary to fulfil the order and comply with the Swiss Federal Act on Data Protection (FADP). The connection to the shop is encrypted. Details can be found in our privacy policy (“Data and privacy” in the settings).

12. Customer account and language

Orders can be placed without a customer account. The shop is available in German, French and English; in case of doubt the German version of these Terms prevails.

13. Governing law and jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, unless mandatory statutory provisions provide otherwise.

14. Final provisions

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected. We reserve the right to amend these Terms at any time; the version in force at the time of the order applies to existing orders.
